PANEL ORDERS THAT THE APPEAL BE DISMISSED AS ABANDONED, ORDER STANDS AS ISSUED, RESPONDENT’S APPLICATION FOR COSTS WILL BE ADDRESSED IN SEPARATE DECISION
This was an appeal by Delta Shake & Shingle (1989) Ltd. and 429155 British Columbia Ltd. of a decision of the Assistant Regional Waste Manager to issue a Pollution Prevention Order. The Order required the Appellants to undertake certain actions and prepare a remediation plan by specified dates following a fire that took place at the landfill owned by Delta Shake & Shingle.
The Appellants failed to appear at the hearing at the time and place stated in the Notice of Hearing. The appeal was considered abandoned and was accordingly dismissed.
