    Ingmar Lee requested a stay of the decision of the Deputy Administrator to issue a pesticide control service licence to the University of Victoria. Mr. Lee argued that pesticide use at the University of Victoria presented a risk to human health and the environment, and that there were safer alternative methods that could be used by the University.

    The Board found that Mr. Lee had not established that a refusal to grant a stay would cause irreparable harm to Mr. Lee’s interests. The Board also found that Mr. Lee failed to establish that the potential for harm to human health and the environment if a stay was not granted outweighed the potential harm to the University of Victoria’s interests if a stay was granted.

    The application for a stay was denied.
