The Appellants each appealed a conditional water licence (the “Licence”) issued by the Regional Water Manager to the Third Parties. The Appellants requested a stay of the Licence pending decisions on the merits of their appeals.
The Board was not satisfied that the Appellants would suffer irreparable harm if a stay was denied.
In addition, the Board found that the Third Parties would incur significant costs and inconvenience if a stay was granted. Therefore, the Board found that balance of convenience favoured denying a stay.
