PARAGRAPH REMOVED, APPEAL DISMISSED WITHOUT COSTS

    Summary

    Decision Date: February 14, 2005

    Panel: Alan Andison

    Keywords: Consent Order

Eurocan Pulp and Paper Co. appealed a decision of the Regional Waste Manager regarding Eurocan’s action plan for elimination of taint.  The plan was developed to address concerns that effluent from Eurocan’s mill taints the flavour of eulachon, a fish that is a traditional source of food and oil for First Nations.

By consent of the parties, the Board ordered that the following sentence be removed from paragraph seven of the decision, leaving the remainder of the decision intact:

“So that there be no misunderstanding, the Regional Waste Manger hereby requires the elimination of tainting of eulachon by March 1, 2007 as determined by an approved taint testing protocol.”

The Board also ordered, by consent of the parties, that, in all other respects, the appeal be dismissed without costs.
