Policy on Use of Generative Artificial Intelligence

The Environmental Appeal Board, Forest Appeals Commission, and Energy Resource Appeal Tribunal have developed and implemented a policy on the use of generative artificial intelligence (AI), which appears in the “Rules and Procedure” page on this website, as well as the similar page on the websites of the other appeal bodies to which this new policy applies.

The policy defines what each appeal body considers to be generative AI in the modern context, where increasingly AI is integrated with all software, including Internet browsers and word processing software. The policy sets requirements and limitations around how parties, participants, and interveners can use generative AI, both in preparing submissions and submitting evidence.

The policy also describes and limits how each appeal body can use this tool, which is all at once powerful and yet raises serious concerns when applied in the context of the justice sector.

The Participant’s Code of Conduct has also been amended minorly, to make clear that it applies to the policy on generative AI.

This policy will likely need to be refined in the future, as the Environmental Appeal Board, Forest Appeals Commission, and Energy Resource Appeal Tribunal ensure there are appropriate safeguards in their processes with the continuing development and use of generative AI.
